Court appoints Administrator on Hajrat Baba Tajuddin Trust

Nagpur: Retired District and Sessions Judge G M Kubde has been appointed as an Administrator of Hazrat Baba Tajuddin Trust, Tajbagh. Principal District and Sessions Judge P V Ganediwala has delegated the function of appointment of trustees to District Judge 2 and Additional Sessions Judge Nagpur O P Jaiswal. He has been asked to take suitable steps for the appointment of nine trustees of Hajrat Baba Tajuddin Welfare Society.

The appointment of administrator was followed after Taj Ahmed Raja filed an application before Principal District and Session Judge Ganediwala for appointment of new trustees of Hajrat Baba Tajuddin Trust. He alleged that three trustees — Sheikh Hussain, Iqbal Ismail Velji and V K Francis — illegally occupied the post of trustees since the past 14 years in violation of provisions of Bombay Public Trust Act, 1950. The Court on September 6 had directed District Judge-2 and Additional Sessions Judge O P Jaiswal to work as administrator.

Meanwhile, Wakf Board filed an intervention application before the court claiming that by virtue of a notification dated December 30, 2014, the property of Wakf is excessively supervised by the Wakf Board and property which has been vested with Hajrat Baba Tajuddin Trust, Nagpur is vested to Wakf Board. Therefore, District Court as well as Joint Charity Commissioner have no jurisdiction to decide the matter and this fact recently came to their knowledge when administrative order was passed, the board claimed while seeking to join as intervenor. The court while allowing intervention application stated by virtue of scheme of 1966 Trust Hajrat Baba Tajuddin Trust, Nagpur is governed and under the control and supervision of Joint Charity Commissioner. The process of appointment of trustee is under the scheme framed by the District Judge is continued up to 2002 and thereafter new body was constituted. These appointments were challenged before the appropriate forum and litigations are going on before the different forums, the court stated.

While deciding the applications, District Court on October 15 restrained three trustees from functioning as trustees of Hajrat Baba Tajuddin Trust and as an interim arrangement appointed retired District and Sessions Judge GM Kubde as an Administrator. Since the annual Urs of Baba Tajuddin is commencing from October 24, and last date of receipt of tenders is October 18, this interim arrangement has been put in place.

Adv Raees Khan and Adv S S Ahmed appeared for the applicant. Taj Ahmed Raja also submitted a memorandum to Guardian Minister Chandrashekhar Bawankule requesting him to direct the machinery to create proper amenities for lakhs of devotees who throng Tajabad to participate in the annual Urs. Guardian Minister has convened a meeting on October 21 to discuss the issue.
