Nagpur: The Magistrate A.A. Babar has sought detailed explanation on an affidavit from a Police Officer of Wadi Police Station as to what is the status of compliance of Section 41A of Criminal Procedure Code on arrest of Dr. Pravin Giripunje in extortion matter.
The Director of Well Treat Hospital Dr. Pravin Giripunje was arrested by the Wadi Police on April 16 on the charge of trying to extort Rs 40 lakh from Vishal Khemchandani whose mother is the landlady of Dr. Giripunje, for vacating the rented premises.
After arresting Dr. Giripunje, he was produced before the Magistrate A.A. Babar on April 17 by the Assistant Police Inspector, Wadi Police Station, D.P. Dhavle with remand papers thereby seeking police remand of Dr. Giripunje.
Adv. Raspal Singh Renu appearing for Dr. Giripunje opposed the request for police remand made by API of Wadi, mainly on the ground that the mandate of Section 41A of Criminal Procedure Code as per the directions of Supreme Court was not complied by the Police.
And when the Magistrate sought explanation from the API, Wadi Police Station on compliance of mandate of Section 41A of Criminal Procedure Code and the directions & guidelines of Supreme Court, he could not give any satisfactory explanation. Hence, the request for the police remand of Dr. Giripunje was rejected by the Magistrate and on an application made by him, Dr. Giripunje was released on bail.
But the trouble for Police Officers of Wadi Police Station has not ended here, now the Magistrate, A.A. Babar has sought detailed explanation on affidavit from them, as to what is the status of compliance of Section 41A of Cr.P.C.
