Nagpur: In the Ram Jhula hit-and-run case, the First Class Judicial Magistrate (JMFC) A.V. Khedkar rejected the Tehsil police’s petition to arrest the accused, Ritika alias Ritu Dinesh Malu. Once again, the police returned from the court empty-handed. The court stated that it had already dismissed the arrest appeal once and therefore did not have the authority to rehear and decide on the same matter. The police were advised to appeal to a higher court.
It is known that after the district court denied her anticipatory bail, Ritu Malu approached the High Court. The High Court deemed the case very serious and denied interim bail, rejecting her plea. Consequently, Ritu surrendered at the Tehsil police station on July 1. On July 2, the police presented her in court, requesting custody, but due to a pending revision, the court ordered her release. Now, the police have appealed for her arrest again.
Government lawyer Rashmi Khaparde informed the court that the police had withdrawn the revision petition. She argued that the case was very serious and thus permission to arrest Ritu should be granted. Defense lawyers Chandrashekhar Jaltare and Milind Chaurasia countered that the court had already rejected the police’s application, so it could not make a decision on the same issue again. Doing so would be against legal procedure. After hearing arguments from both sides, the court dismissed the police’s appeal.
