Pardi Flyover: Nagpur CA accuses Govt deptts of high-handed action in land acquisition

Nagpur: A Chartered Accountant from Nagpur has accused Collector office, NMC and Nagpur Improvement Trust (NIT) of arbitrary and high-handed action in land acquisition and levy of ground rent for the ongoing Pardi Flyover construction under Land Acquisition Act.

The CA Niraj Sanjay Jain, resident of Plot No. 276 East Wardhaman Nagar, Besides Sukhsagar Apartment, Nagpur, in a communication with Nagpur Today, said that a part of our land has been acquired by the government for the ongoing Pardi Flyover construction under Land Acquisition Act. “Initially NMC offered to acquire the land by sale deed or (in Marathi “thet kharidi”). While we gave our consent for that, we were told that the documents needed some updating from the City Survey. The then NMC Commissioner Abhijeet Bangar also assured to arrange the camp from the City Survey office for speedy updation of documents. He did arrange the camp but they did not do any work,” Jain claimed.

He further said that while they were waiting for City Survey updation, NMC abruptly (without giving any notice ) said that they had closed the window for “thet kharidi” and now the land will go under compulsory acquisition. This reduced the compensation of land acquired by nearly 20%. The problems didn’t end here. The markings the NHAI made on the plot were more than the area for which the compensation was paid. When the matter was taken to the Land Acquisition Officer as to why excess land was acquired than notified , they said you go and apply for “mojni” and prove excess acquisition. It is well in public knowledge how difficult it is to get any work done in City Survey office infamous for its red-tapism. Collectorate doesn’t feel any onus to give any proof of measurement to landholders to vouch for the fact that only the notified area of land is being acquired. The onus of providing the excess acquisition of land is being put on landholders, the CA complained.

“Secondly, despite compulsory acquisition by the Collectorate, NIT is continuing to send ground rent demand without reducing from it the acquired part. Now if two government bodies won’t act in sync, is it really the citizen’ job to run from pillar to post to save himself from wrong taxation? I have written a complaint to Land Acquisition Officer Shekhar Ghadge and online complaints to NIT but the issue stands unresolved,” Jain claimed.
