Nagpur: In a significant development, the Nagpur Bench of the Bombay High Court has issued notices to former Nagpur Police Commissioner Amitesh Kumar and the then Additional Commissioner of Police (Crime) while hearing a criminal writ petition seeking action against the former police chief. The court has directed the respondents to file their replies within three weeks and has scheduled the next hearing for September 1.
The matter came up before a division bench comprising Justice Urmila Joshi-Phalke and Justice Raj Wakode. The petition has been filed by advocates Satish Uke and Pradeep Uke, alleging serious irregularities in the investigation process and seeking an independent and impartial probe.

According to the petition, the investigation in the concerned case was allegedly misused, raising questions about the manner in which the probe was conducted. The petitioners have requested the High Court to direct that the investigation be carried out through the jurisdictional Magistrate and that the findings be submitted before the court.
The petition also levels allegations regarding the role of former Police Commissioner Amitesh Kumar in the matter. However, the High Court has not expressed any opinion on the merits of those allegations at this stage. Instead, it has sought responses from the concerned officials before proceeding further.
The petition also refers to an investigation being conducted by Ajni Police Station and questions its fairness. The petitioners have urged the court to consider transferring the probe to the Crime Branch or the Economic Offences Wing (EOW) to ensure an independent investigation.
The plea stresses that only a fair and transparent probe can establish the complete facts of the case and uphold public confidence in the investigation process.
Court seeks replies within three weeks
During the hearing, the High Court directed former Police Commissioner Amitesh Kumar and the then Additional Commissioner of Police (Crime) to submit their replies within three weeks. The court is expected to consider the responses before deciding on any further directions in the matter.
The case has now been posted for further hearing on September 1, when the court will take up the replies filed by the respondents along with the submissions of the petitioners. At this stage, the High Court has only issued notices and initiated the process of hearing all concerned parties, without making any findings on the allegations raised in the petition.
