Talaq-e-biddat is not in violation of articles 14, 15, 21 and 25 of the constitution

Triple talaq: The Supreme Court says it hopes the legislature will consider Muslim law while bringing in the new law. Chief Justice of India JS Khehar said that all parties must keep politics aside while deciding the law. One of the five judges also said that triple talaq is unconstitutional. Justice K Joseph, one of the five judges, hearing the case said, that triple talaq is bad in law. The court has also asked the government to bring legislation within 6 months.

CJI Khehar however said Talaq-e-biddat is an integral part of the Sunni community practiced since 1000 years. He also said that Talaq-e-biddat is not in violation of articles 14, 15, 21 and 25 of the constitution. Talaq-e-bidat has allowed men to pronounce talaq thrice in one sitting, sometimes scrawled in a written talaqnama, or even by phone or a text message.
