Navodaya Bank Scam: HC Rejects ₹3 Crore Transfer Plea

Nagpur: The Nagpur Bench of the Bombay High Court has rejected a plea seeking transfer of ₹3 crore deposited with a special court to Navodaya Urban Cooperative Bank for settling an account under a One-Time Settlement (OTS) in the alleged Navodaya Urban Cooperative Bank scam case.

The application was filed by accused Manmohan Hingal, who is facing allegations of obtaining fraudulent loans through alleged collusion with bank management.

While granting Hingal bail in 2019, the High Court had directed him to deposit a total of ₹3 crore with the special court as a condition of bail. The order required ₹1 crore to be deposited within seven days and the remaining ₹2 crore within 16 weeks.

Bail Condition Included Cancellation Provision

The earlier High Court order stated that failure to deposit the prescribed amount within the stipulated period would result in cancellation of bail. The special court could also issue a non-bailable warrant against the accused.

Hingal informed the court that he had complied with the order and deposited the entire ₹3 crore with the special court.

Subsequently, he expressed his intention to settle his account with the bank through an OTS. Based on this, he sought permission to transfer the ₹3 crore deposited with the special court to Navodaya Urban Cooperative Bank.

Court Says Purpose of Original Order Must Be Preserved

After hearing the application, Justice Nerlikar rejected the plea. The court observed that permitting the deposited amount to be transferred to the bank would undermine the purpose for which the original judicial order required the money to be deposited.

Advocate Nitin Jaiswal appeared for the applicant, while Additional Government Pleader N. B. Jawade represented the state.
