Nagpur Consumer Forum sends notice to Khandelwal Sarees for selling defective sarees to consumers

Nagpur: Acting on a complaint, the District Consumer Disputes Redressal Forum, Nagpur, has issued a notice to Dharampeth-based Khandelwal Sarees for selling defective sarees to consumers. A reply has been sought and the matter has now been posted on December 26, 2022.

The case was put up before Chandrika K Bais, Presiding Member, and Subhash R Ajane, Member of the Forum.

Adv M S Sharma, representing the complainant Unmesh Madame, informed the District Consumer Disputes Redressal Forum, Nagpur, that the Dharampeth-based firm Khandelwal Sarees is one of the leading saree stores of Central India. On May 19, 2022, the complainant Unmesh Madame, his fiancée, and other seven members of the family had gone to the saree shop to purchase sarees for the engagement ceremony.

The consumer complainant purchased a silk saree at the cost of Rs 15,890 at around 9.30 pm. Taking advantage of closing time of the shop, the respondent hurriedly sold a piece of defective saree without even permitting the consumer complainant, his fiancée and others to thoroughly inspect the saree.On May 29, the day of engagement ceremony, the saree was opened. The fiancée of the complainant noticed that there were some tiny holes on the middle part of the saree, Adv Sharma stated.

He further said that the complainant and his fiancée immediately approached the respondent on May 30, 2022, and made a complaint about selling of the defective saree. The respondent firm Khandelwal Sarees though has not accepted the same but tried to convince the complainant and others that these are thread marks and not holes and said will do something and retain the defective saree. Thereafter, on June 6, 2022, the saree store called the consumer complainant and returned the same defective saree without doing anything and without accepting the fact that he sold the defective piece of saree, Adv Sharma contended.

Being aggrieved, the complainant Unmesh Madame sent a legal notice to the saree store requesting to withdraw defective saree and refund the consideration of Rs. 15,890 to the Consumer Complainant within a period of 15 days from the date of receipt of this legal notice and also pay compensation of Rs. 1,50,000 for mental harassment and for putting him into unwarranted litigation and cost of legal notice is Rs. 50,000.
