Local Body Tax department conducted Search & Seizure Operation at Phoenix Industries

Nagpur: Local Body Tax department conducted Search & Seizure Operation at the establishment named M/s Phoenix Industries, Shop No.63,Yeshwant Stadium, Dhantoli, Nagpur; owned by Rahul Chirkutji Wahane. The dealer trading in BLUE STAR branded AC, REFRIGERATOR, WATER COOLER, AIR COOLED DUCT UNIT & SPARE PARTS is registered under LBT. The dealer has imported goods worth Rs. 4.25 crores since inception of LBT but has not paid single paisa against an estimated liability of Rs.17 lacs. As per LBT Rules, the dealer will now be required to pay penalty @ two times the LBT liability i.e. Rs 34 lacs. Total approximately liability RS.51 lacs. The dealer has also not filed the annual returns for 2013-14.

Second search operation was conducted on the establishment named A.S.Iyer Construction Pvt Ltd. Plot No.8, Old Verma Layout, Nagpur . The dealer is Civil Contractor & has made purchase worth Rs. 4 crores since inception of LBT i.e. 1.4.2013 but has paid LBT Rs 19,000/- only till date. During the operation the Department has seized the relevant documents such as 5 files of purchase invoices. Department will investigate the matter & will initiate further appropriate actions. The dealer has also not filed the annual returns for 2013-14.

Third search & seizure operation was conducted on the godown owned Pralhad Laxmandas Damani, above Vrindavan Hotel, Mahajan Market, Sitabuldi, Nagpur. The dealer trading in ready made garments is unregistered under LBT, during operation the dealer has not produced the required documents of the goods in the godown, hence the godown has been sealed.

The search operations were conducted under the guidance of Hon’ble Municipal Commissioner, Shyam Wardhane and Hon’ble A.Dy.M.C. Pramod Bhusari, under the supervision of Milind Meshram, Assistant Commissioner(LBT). The officers/officials involved in the operation are Yadav Jambhulkar, Rajesh Meshram, Tarachand Khandate, LBT Officer ; Inspectors Sanjay Mendule, Vilas Chahande, Ramesh Paddhan, Sumer Gajbhiye, Suresh Dhupe, Baban Puri, Narayan Wankhede; Jr. Inspectors Surendra Hore, Chandrashekhar Mohite, Kishor Charde, Kailash Ukey, Shailesh Bharadwaj; Mohrir Nana Kakade, Jageshwar Wankhede and Driver Prakash BOLAKHE, Raju Sonekar, Sheshrao Shinde;

Many dealers are importing goods and not making LBT payments on the pretext of news in local dailies that LBT will be scrapped. The dealers should take note that even if the LBT is scrapped it will be from the date of such notification by the Government. Therefore, the dealers are requested to pay LBT as per the rules on the goods imported till date to avoid action by the department.
