Nagpur: In a significant legal development, the Bombay High Court has ruled to quash the First Information Report (FIR) filed against BJP Corporator Virendra Kukreja and the counter FIR against Babu Khan, arising from an altercation on February 27, 2022.
The incident unfolded when Gangubai Waghmare and a group of locals visited Kukreja’s office, leading to a confrontation between Waghmare and Kukreja. Subsequently, an FIR was registered against Kukreja under various sections of the Indian Penal Code (IPC) and the SC and ST (Prevention of Atrocity) Act.
Advocate Rawlani, representing Kukreja, argued in court that a counter FIR had been lodged by their party worker Leena Somkuwar. This counter FIR alleged that Babu Khan and others had visited Kukreja’s office and caused damage to the property. Consequently, a counter FIR was registered, citing multiple sections of the IPC along with the SC and ST (Prevention of Atrocity) Act.
Both legal teams contended that the dispute had political undertones and had been amicably settled between the parties involved. After hearing the arguments from both sides, the division bench consisting of Justices Nitin Sambre and Valmiki Menezes decided to quash the FIR registered against Virendra Kukreja as well as the counter FIR against Babu Khan.
As part of the judgment, Kukreja has been directed to deposit Rs 1 Lakh, while Babu Khan is required to deposit Rs 50,000 as costs to the High Court Legal Aid Service Committee. Advocates Ramesh Rawlani and Atul Rawlani represented Virendra Kukreja in this case.
