High Court directs NMC to repay Rs 2 crores with interest to Godrej Anandam World City

NMC had illegally demanded Godrej Anandam World City to pay High Rise Tax

Nagpur: In a significant turn of events, the Nagpur Bench of Bombay High Court directed the Commissioner of Nagpur Municipal Corporation to repay Rs two crores charged illegally as “High Rise Tax” along with interest to Godrej Anandam World City on October 8, 2015.

The Godrej Anandam World City was constructed by Gold Bricks Infrastructure Private Limited at former Model Mills land in Ganeshpeth. When they started the construction on February 16, 2010 they paid Rs 919352/- (Rs Nine lakhs nineteen thousand three hundred and fifty two) under Fire Prevention and Life Safety Measures Act.

The Godrej Anandam World City further constructed some more floors and for that they again made a payment of Rs 2349290/- (Rupees Twenty Three lakhs forty nine thousand two hundred and Ninety) on October 21, 2011.

After they finished the constructions, the then Commissioner of Nagpur Municipal Corporation sent a notice to Godrej Anandam World City on February 27, 2012 demanding them to pay Rs two crores as “High Rise Tax”.

The Godrej Anandam World City promptly deposited the demanded amount of Rs two crores to NMC. However, they challenged the demand in the High Court.

After hearing the case thoroughly, Justice Vasanthi Naik and Justice AIS Cheema of Nagpur Bench of Bombay High Court, quashed the NMC’s demand order and directed the Commissioner of Nagpur Municipal Corporation to repay Rs two crores charged illegally as “High Rise Tax” along with interest to Godrej Anandam World City.

This decision may become a good precedence and many others who were illegally charged may now come forward and demand their money back.
