Blatant misuse of residential land by medicos for commercial activity

: The CEO of Katol Municipal Council Jumma Pyarewale has written to the District Collector on April 1, 2016 requesting an enquiry from State Health Department into the blatant use of residential land within the Municipal Council area for commercial activities. District General Secretary of Congress Party Pratap Tate too raised this issue and demanded immediate action on this. It is alleged that many private hospitals have been constructed and being run on the land meant for residential purposes.

It is alleged that one Doctor identified as Doctor Amit Jayant Band has constructed a building and is allegedly running Dhanwantari Hospital on land bearing No 5/13+14, Survey No. 761- (No 3420). Doctor Amit Band had acquired a permission to run a hospital under Mumbai Nursing Home Registration Act 1949. The renewal of this registration has been acquired only till 2012-13.

On March 31, 2012, he acquired permission to construct a residential building of G+2 floors. However, he has been using this premise for commercial use from December 27, 2013. He has also not yet submitted the Fire Prevention for Public Buildings Report mandatory under the Maharashtra Fire Prevention and Life Safety Measures Act, 2006.

The Municipal Council has also issued a notice to the Doctor for violation of these rules and regulations on August 13, 2015. During investigations, the team of officials from Municipal Council also found that the Doctor had allegedly constructed his building consuming excess portion of the land than the legally approved plan.

An action was also initiated under sections 43 and 52 of the Maharashtra Regional and Town Planning Act, 1966. This case is said to be pending in the Katol Court too. A letter has also been written to the District Surgeon seeking action against the erring Doctor.

Similarly, another doctor identified as Sachin Wamanrao Ghate too has constructed a building on Plot No 5/15, City Survey No. 3423 and is allegedly running a hospital named Ghate Hospital and Orthopedic Clinic. Doctor Sachin Wamanrao Ghate had acquired a permission to run a hospital under Mumbai Nursing Home Registration Act 1949 on February 4, 2006. The renewal of this registration has been acquired only till 2013-14.

On October 9, 2009, he acquired permission to construct a residential building of G+2 floors. However, he has been using this premise for commercial use from December 27, 2013. He has also not yet submitted the Fire Prevention for Public Buildings Report mandatory under the Maharashtra Fire Prevention and Life Safety Measures Act, 2006.

This building is near the State Highway 247 and 248. This Doctor has allegedly violated the Control Line.

On December 30, 2015, a notice was issued by the Katol Municipal Council under the Monopolistic and Restrictive Trade Practice under MRTP Act. During investigations, the team of officials from Municipal Council also found that the Doctor had allegedly constructed his building consuming excess portion of the land than the legally approved plan. An action was also proposed under sections 43 and 52 of the Maharashtra Regional and Town Planning Act, 1966. Due to this building smooth flow of vehicular traffic is also hindered.

Another erring doctor identified as Doctor Mahesh Kishanlal Tawri too has constructed a building in Old Ward No 4, on Property No 126 and 127, City Survey No. 2899 and is allegedly running a hospital named Tawri Dental Hospital. Doctor Mahesh Kishanlal Tawri had acquired a permission to run a hospital under Mumbai Nursing Home Registration Act 1949 on March 31, 2008. The renewal of this registration has been acquired only till 2012-13.

On September 3, 2011, he acquired permission to construct a residential building of G+2 floors. However, he has been using this premise for commercial use from September 3, 2011. He has also not yet submitted the Fire Prevention for Public Buildings Report mandatory under the Maharashtra Fire Prevention and Life Safety Measures Act, 2006.

This building is near the State Highway 248. This Doctor has allegedly violated the Control Line. A letter has been sent to Katol Police Station for action against the doctor.

Another erring doctor identified as Doctor Naresh Mohanlal Rathi too has constructed a building in Old Ward No 3, on Property No 133, City Survey No. 2941 and is allegedly running a hospital named Ashirwad Hospital. Doctor Naresh Mohanlal Rathi had acquired a permission to run a hospital under Mumbai Nursing Home Registration Act 1949 on February 8, 2008. The renewal of this registration has been acquired only till 2014-15.

On May 28, 2010, he acquired permission to construct a residential building of G+2 floors. However, he has been using this premise for commercial use from September 3, 2011. He has also not yet submitted the Fire Prevention for Public Buildings Report mandatory under the Maharashtra Fire Prevention and Life Safety Measures Act, 2006.

This building is near the State Highway 248. This Doctor has allegedly violated the Control Line. On December 29, 2015, a notice was issued by the Katol Municipal Council under the Monopolistic and Restrictive Trade Practice under MRTP Act. An action was also proposed under sections 43 and 52 of the Maharashtra Regional and Town Planning Act, 1966. Due to this building smooth flow of vehicular traffic is also hindered.

The above matter has been repeatedly raised by District General Secretary of Congress Party Pratap Tate. The CEO of Katol Municipal Council Jumma Pyarewale has written to the District Collector on April 1, 2016 requesting an enquiry by the State Health Department into the blatant use of residential land within the Municipal Council area for commercial activities by these four erring Doctors.
