Nagpur RTO firing case: HC rejects pre-arrest bail to MVI Geeta Shejwal

Nagpur: Justice Urmila Joshi-Phalke on Thursday dismissed the pre-arrest bail application of Motor Vehicle Inspector (MVI) Geeta Shejwal in connection with an attempted murder case registered at Bajaj Nagar police station.

Following the rejection of her pre-arrest bail by the District Sessions Court, Shejwal had filed an application before the High Court last month. During the court proceedings, the prosecution asserted that Shejwal had fired a shot at MVI Sanket Gaikwad in his flat. They sought custody to investigate the incident, unravel the motive behind the shooting, and identify senior Regional Transport Office (RTO) officials involved in the case.

The prosecution presented evidence, including reports from a ballistic expert, medical records, Call Details Records, and the locations of both MVI Gaikwad and MVI Shejwal, along with their statements. The defence counsel contested the prosecution’s claims.

After considering arguments from both sides, Justice Urmila Joshi-Phalke observed discrepancies in the statements of MVI Gaikwad and MVI Shejwal. The judge also noted contradictions in the mobile tower locations and the details mentioned in the statements which raised doubts about the incident. Finally, the Judge rejected MVI Shejwal’s pre-arrest bail application.

MVI Shejwal, with a history of previous criminal cases, now faces charges under Section 307 of the Indian Penal Code (IPC) for attempted murder. MVI Sanket Gaikwad is implicated under Section 201 of the IPC for destroying evidence. The police investigation revealed that on May 5, 2022, MVI Shejwal fired a shot at MVI Gaikwad, with the primary dispute over funds collected by the ‘Flying Squad’ identified as the motive behind the attack.
