HC Admits PIL Over Illegal Liquor, Unauthorised Constructions in Bajaj Nagar–Shankar Nagar Belt

Nagpur:  The Bombay High Court Nagpur Bench has admitted a PIL alleging illegal liquor consumption and unauthorised constructions in Bajaj Nagar, bringing multiple popular establishments under scrutiny.

The court has sought responses from authorities, including the Nagpur Municipal Corporation, as residents raise concerns over late-night disturbances and alleged violations on PKV land.

PIL Flags Violations in Key Residential Belt

The Public Interest Litigation, filed by Dr. Lalit Harode and other residents, highlights alleged violations across the busy stretch from East Shankar Nagar to Bajaj Nagar-an area that has seen rapid growth of restaurants, cafés, and lawn venues in recent years.

Petitioners have accused several establishments-including Bakasur, NH-1, Corner House, Jack N Jill, Jagdish Saoji, and Sai Vatika Lawn—of operating beyond permitted limits, particularly in terms of liquor service and operational timings.

Residents claim that frequent late-night parties, DJ music, and live bands have been disturbing public peace in what is otherwise a largely residential zone.

Court Seeks Accountability from Authorities

A division bench of Justice Anil Kilor and Justice Raj Wakode took cognisance of the matter and initiated proceedings.

The court has:

  • Impleaded the Nagpur Municipal Corporation as a respondent
  • Directed Bajaj Nagar Police to file an additional affidavit
  • Indicated the need to examine enforcement gaps among departments

The matter remains under consideration, with further responses expected.

Police Cite Limited Jurisdiction

In its affidavit, Bajaj Nagar Police clarified that action against unauthorised constructions and encroachments falls under the jurisdiction of civic authorities and not the police.

Police stated that:

  • Notices have been issued to hotel and restaurant owners periodically
  • A formal communication has been sent to the Municipal Commissioner regarding rooftop venues operating without required permissions
  • Regular night patrols and surprise inspections are being conducted to maintain law and order

Officials also urged the court to include the Excise Department and civic authorities for effective enforcement.

History of Complaints and Action

The issue is not new for this part of Nagpur. Residents of Shankar Nagar and Bajaj Nagar have repeatedly raised concerns over noise, traffic congestion, and alleged violations linked to commercial activity in residential pockets.

Police data submitted to the court revealed:

  • 280 FIRs registered between 2016 and 2025 in connection with illegal activities in the area
  • Specific cases against Jagdish Saoji restaurant in 2018
  • Temporary sealing of the establishment for 15 days in December 2021

PKV Land Use Under Question

A key concern raised in the PIL is that some establishments are allegedly operating on land belonging to Panjabrao Deshmukh Krishi Vidyapeeth (PKV).

This has triggered questions around land-use permissions and whether commercial activities are being carried out in violation of zoning norms.

Growing Urban Pressure in Shankar Nagar-Bajaj Nagar

The Shankar Nagar-Bajaj Nagar belt is one of Nagpur’s prominent urban stretches, known for:

  • Educational institutions and residential societies
  • Increasing number of restaurants and nightlife spots
  • Rising concerns over noise pollution and parking congestion

Residents argue that unchecked commercial expansion is affecting the livability of the area.

The PIL has brought renewed attention to regulatory enforcement in one of Nagpur’s busiest urban corridors. With multiple agencies involved, the case is expected to set a precedent on how illegal commercial activities, licensing violations, and land-use issues are addressed in the city.
