
The petitioners — Jayshree Khadatkar, Shalini Patil and Anjirabai Gavande — had claimed that they purchased plots in Ambedkar Nagar Co-operative Housing Society at Shivangaon through registered sale deeds in 1995 and 2001. The land was later acquired in 2005-06 for the MIHAN Cargo Hub project.
Although compensation for the acquired land was already paid as per court orders, the petitioners argued that they were also entitled to a fully developed 150 sq m rehabilitation plot under a 2007 Maharashtra Government Resolution related to project-affected persons (PAPs).
However, the State Government and MADC opposed the plea, stating that the rehabilitation policy applies mainly to displaced residents whose homes or village settlement lands were acquired.
The High Court observed that the petitioners failed to prove they were occupying or residing on the acquired land continuously for at least five years before the acquisition process began — a key requirement under the Maharashtra Project Affected Persons Rehabilitation Act, 1999.
The court also noted that official land records at the time of acquisition only reflected the name of the housing society and not the petitioners as occupants.
Considering the legal provisions and available records, the High Court ruled that the petitioners do not qualify as “project-affected persons” under the rehabilitation policy and dismissed the plea.
