HC blasts ‘lawlessness’ in Nagpur’s Civil Lines; 10 wedding lawns found illegal

Only 3 of 13 venues, CP Club, Gondwana Club and Ladies Club, have clear permissions; Court warns of strict action, licence cancellations

Nagpur: Taking a fierce stand against unchecked noise and air pollution in the Nagpur’s elite Civil Lines area, the Nagpur Bench of the Bombay High Court has strongly rebuked the administration for its glaring failure to enforce the law.

Hearing multiple PILs along with a suo motu case, a Division Bench of Justices Anil Pansare and Nivedita Mehta expressed sharp displeasure over the authorities’ inaction, observing that there is a complete lack of will to implement the law.

“VIP area turned violation hub”

The Court was shocked to learn that out of 13 prominent marriage lawns and clubs operating in Civil Lines, the Nagpur Municipal Corporation has clear permission records for only three, CP Club, Gondwana Club and Ladies Club, while the status of the remaining 10, including Swagat Lawn, remains unclear and unchecked.

The Civil Lines area has 13 lawns and halls including Swagat Lawn and Hall, Great Grand Lawn, Season Lawn, Sarpanch Bhavan, Gondwana Club, CP Club, Srushti Lawn, Officers Club, Ladies Club, Prestige Hall and Lawn, Jawahar Vidyarthi Sabhagruha, Satpuda Lawn and Deshpande Sabhagruha.

The Bench termed the situation alarming, noting that large-scale events continue with blatant violations, turning a designated VIP zone into a hub of noise and environmental breaches.

The Court did not mince words in criticising the police and civic authorities, calling their response grossly inadequate and insensitive to public health concerns.

It questioned the logic of assigning just one Assistant Police Inspector to handle such a serious and widespread issue. The Bench also raised doubts over the routine invocation of Section 168 of the Bharatiya Nagarik Suraksha Sanhita and Section 188 of the Indian Penal Code in noise pollution cases, indicating weak and ineffective enforcement.

Citing earlier Supreme Court rulings, the Court highlighted the devastating ecological impact of unchecked noise, stating that loudspeakers and firecrackers are driving birds away from urban habitats.

Stern warning to officials

Making its intent clear, the Court warned that continued failure will invite accountability, and officials will be held personally responsible if the situation does not improve.

To rein in the chaos, the Court issued stringent new guidelines:

• Fresh Permissions Mandatory: All lawn, club, and marriage hall owners, along with event managers and sound operators, must reapply and submit affidavits assuring compliance with noise limits.

• Strict Decibel Cap: Noise must not exceed 55 dB in residential areas and 50 dB in silent zones between 6 am and 10 pm.

• Night Ban: Complete prohibition on sound systems from 10 pm to 6 am.

• Speaker Restrictions: Loudspeakers cannot be installed above 15 feet and must face inward, not towards surrounding areas.

• Mandatory Awareness Boards: All venues must display boards highlighting the harmful effects of noise and air pollution.

• Public Complaint Portal: The State Government has been directed to launch an online system for citizens to report violations, with mandatory disclosure of action taken.

Licences at risk

The Court reiterated that authorities must immediately verify whether all such establishments comply with the Noise Pollution Rules 2000 and guidelines of the Maharashtra Pollution Control Board.

It issued a clear warning: Any violation must result in immediate cancellation of licences.

With this hard-hitting intervention, the High Court has sent a strong message, environmental violations in the name of celebrations will no longer be tolerated.
