Nagpur: Tehsil Police in Nagpur have booked four members of a family and four employees of City Survey Office No. 1 under Sections 420, 419, 465, 467, 471, 167, 120-B & 34 of IPC on 26/12/2023 for preparing false and fabricated documents with the motive of cheating government and grabbing land.
The 8 accused booked are Late Harshad Amrutlal Shah, Meena Harshad Shah, Amar Harshad Shah, Chetan Harshad Shah, Anil Ratiram Fulzele, City Survey Officer No 1, Dhiraj Chintaman Ninave, Land Surveyor City Survey Office No 1, Sunil Bhimrao Gaikwad, Land Surveyor City Survey Office No 1, Inward Outward Clerk, City Survey Office No 1 on the complaint of Nilesh Mehta
According to police, the accused persons namely Late Harshad Amrutlal Shah, Meena Harshad Shah, Amar Harshad Shah, Chetan Harshad Shah, had made an application with the City Survey office Nagpur No 1 for the correction of the area dated 22/11/2018. As per this application, the City Survey office Nagpur No 1 issued notice on 27/09/2019 to the 10 people to remain personally present on the site on 05/10/2019 for measurement of the area.
As per the report dated 08/11/20219 of the City Survey office Nagpur No 1, it was mentioned that the site inspection was done on 30/10/2019 and the accused persons, neighbour and punch witness were present and their statement was recorded. In their said report it is specifically mentioned that Nilesh Amarchand Mehta and Hemlata Vijaykumar Mahendru were personally present and their statement was recorded.
On investigation it was revealed that their said report also contains the false signature of these persons, The accused persons had prepared false and fabricated documents, where they marked the presence of dead persons namely Ramchandra Chaturbhuj Sewak was present whereas he died on 24/11/1997. Hemlata Vijaykumar Mahendru was present whereas she died on 26/11/2018, Shrikant Kabra was also present whereas he died on 14/12/2004. Death certificates of all these persons are collected by the investigating officer. Even the presence of Mangilal Motilal Jain was shown who died on 30/10/1976.
Further, the complainant Nilesh Mehta never received any such kind of notice from the City Survey office Nagpur No 1 nor was he personally present on that date. Neither his statement was recorded nor he had signed any documents relating to measurement of the area. The copy of the report of spot enquiry is showing that the all above mentioned persons were personally present and the said document contained their signatures also. The accused persons had prepared false documents by marking the dead persons alive and putting their signatures in the official documents with mala fide intentions to increase their area by 37.125 sq. mtrs and thereby they have fraudulently usurped land between Survey No 560 and 561 and shown Nazul lane came in their share of land.
The accused persons having hand in glove with officials of City Survey Office No 1 and adopting illegal means had captured government land valued in lakhs on the basis of false and fabricated documents and fraudulently and dishonestly used the said documents as genuine for encroaching upon the government land and increased their area.
According to police, the accused persons indulged in cheating and preparing false and fabricated documents, and marked the presence of a false person and cheated the government as well as the complainant. The people who are already dead were marked as present and recorded their statements and show the presence of the complainant though no notice was issued to him. It is also pertinent to mention here that the accused persons had submitted the wrong documents and on the basis of the same they come to the conclusion that the said Nazul Lane come into their share of land and by adopting illegal means had captured government land valued in lakhs on the basis of the false and fabricated document as well as increase their land.
The accused persons Amar Harshad Shah, Chetan Harshad Shah were arrested by the investigating agency, however accused persons Anil Ratiram Fulzele, City Survey Officer No 1 and Dhiraj Chintaman Ninave, Land Surveyor City Survey Office No 1 had filed their anticipatory bail before the sessions court Nagpur. The sessions judge rejected their ad interim anticipatory bail application and the main application is pending before court. Further investigation in this matter is going on.
