CBDT Chief adamant attitude for Extending due date for filing ITR created Hoax

On Oct 3, 2015 delegation of Chartered Accountants led by CA Rajesh Loya, CA Kailash Jogani and CA Ashish Mukim met Nitin Gadkari and explained him about CBDT Chief adamant attitude for Extending due date for filing Income Tax Return.

They explained Nitin Gadkari that Due date for filing Income Tax Return for the assessee covered under compulsory Tax Audit for the A.Y. 2015-16 was 30.09.2015. Income Tax Form for filling the ITR were notified very late i.e. in the month of August 2015. It was almost delayed by 5 months.

CA fraternity from all over India demanded extention in due date only by 1 month i.e. upto 31.10.2015. Even National President of ICAI has given representation in this regard. But CBDT has not considered professionals legitimate demand.

Many petitions were filed in various courts by CAs, professional bodies and trade association. When two courts gave verdicts for extension of due dates, CBDT extended due dates in only those states, whereas income tax is a PAN India Taxation. Even after verdict of Honorable Bombay High Court, notification was issued after due date was over i.e. on 1st October 2015, and after Revenue Secretary Tweets that date has been extended for whole India.

This was very unethical behavior on part of CBDT and Bureaucrats.

Nitin Gadkari has assured that he will explain the matter to Arun Jaitley, Finance Minister of India. Further he has assured that from next year onward CBDT will release Income Tax Return forms well advance in time.

Prominently present in the meeting were CA Satish Sarda, CA Swapnil Agrawal, CA Sandeep Surana, CA Shyam Modi, CA Jethalal Rukhiyana, CA Ajay Vaswani, CA Deepak Jethwani, CA Saket Bagadia and CA Avigat Ganeriwal.
