LBT search & seizure action on M/s Gayatri Computers and Stationers

Local Body Tax department search and seizure action on an establishment named M/s Gayatri Computers and Stationers, Plot No. 105/A, Vastu Radhey Apartment, Near Dhantoli Police Station, Dhantoli, Nagpur. The dealer is trading in computer printers and cartridges etc. and is registered under LBT. The dealer has made purchases worth Rs.1,83,60,832.91 and has made LBT payments worth Rs.1,36,771/- during the financial year 2013-2014. As per the documents seized from the dealer, it is found that the dealer is importing computer printers and cartridges from online networking companies, mostly from amazon.in, in the names of fake customers and addresses, since the online companies deliver goods only to the end users. The department has seized the purchase and sales documents pertaining to financial year 2014-15 and will verify the payments against the imports made from online networking companies.

Notice of demand issued by the department in some of the earlier search and seizure cases have not been honoured by dealers like Yomax Electronics, Sainath Aluminium and Glass works and Mobile Villa. Out of this M/s Yomax Electronics approached the Hon’ble High Court wherein the Hon’ble High Court directed the dealer to deposit Rs. 40.00 lacs. As a result, the dealer approached Hon’ble Apex Court, where the case was dismissed but the dealer has not yet honoured the order passed by Hon’ble High Court. The department has already initiated the action to seize the bank accounts of all these dealers as per the LBT Rules and Enforcement Mannual.

The search and seizure action dated 1.1.2015 was conducted by LBT Officers Shri Yadav Jambhulkar and Shri Venkat Jichkar; Asstt.LBT Officers Shri Narayan Wankhede, Shri Sanjay Mendule, Shri Sumer Gajbhiye, Shri Vilas Chahande, Shri Dilip Mate, Shri Hore and Shri Ramesh Giri. The Junior Inspectors Shri Mohite, Shri Uke and Shri Shailesh Bharadwaj were also part of the operation. The operation was initiated under the supervision of Assistant Commissioner, Shri Milind Meshram under the able guidance of Hon’ble Municipal Commissioner and Additional Dy. Mpl. Commissioner.
