Nagpur: Action against illegal basement shops at Poonam Chambers is underway, but three establishments have received temporary protection from the court. The Bombay High Court Nagpur Bench has stayed coercive action against these three shops, while the remaining units continue to face demolition and eviction by the Nagpur Municipal Corporation (NMC).
Acting on a show-cause notice issued on January 30, 2026, the court directed the civic body not to take any action against Shops No. 44, 45, and 46 until February 6, 2026. The interim relief was granted by a division bench comprising Anil S. Kilor and Raj D. Wakode during the hearing of Writ Petition No. 1116/2026 filed by Vinod Dinanath Diseja and others. Petitioners were represented by advocate Shyam Devani.
The court made it clear that its protection applies only to these three shops. All other allegedly illegal basement units remain subject to NMC action—and the civic body has already moved in.
On Thursday morning (February 5), NMC’s encroachment removal department began clearing goods from basement outlets operating under the name “Poonam Bazaar.” The corporation maintains that the basement was being used commercially in violation of the sanctioned building plan.
During the proceedings, the bench noted that the current show-cause notice is linked to older matters—Writ Petition No. 198 of 2005 and Writ Petition No. 1025 of 2016. Observing that the present petition should be heard along with those earlier cases, the court directed the registry to place the matter before the appropriate bench on February 6, 2026.
Following the High Court’s order, demolition and enforcement against the three protected shops has been paused for now. For the rest, NMC’s drive continues. Traders and residents are watching closely as the next hearing approaches.
