Local Body Tax department conducted Search & Seizure Operation at J C Sales & Services

Nagpur:  Local Body Tax department conducted Search & Seizure Operation at the establishment named M/s J C Sales & Services, 128/A, Ram Nagar, Nagpur; owned by Omprakash Tikale. The dealer trading in BLUE STAR/Haier branded AC, REFRIGERATOR, WATER COOLER, AIR COOLED DUCT UNIT, SPARE PARTS, FURNITURE & Electronics goods is registered under LBT. The dealer has imported goods approximately worth Rs. 45 lacs since inception of LBT but did not pay single penny against an approximately estimated liability of Rs.1.7 lacs. As per LBT Rules, the dealer will now be required to pay penalty @ two times the LBT liability. The dealer has also not filed the annual returns for 2013-14.

Second search operation was conducted on the establishment named M/S Climatech Solutions,31A,Ramkrishna Nagar, Wardha Road, Nagpur . The dealer d trading in BLUE STAR branded Visi Cooler ,Chest Freezer, Water cooler, Evaporating unit, Condensing Unit is registered under LBT. The dealer has imported goods approximately worth Rs. 56 lacs since inception of LBT but has paid LBT Rs 10,000/- only. During the operation the Department has seized the relevant documents such as 4 files of purchase invoices. Department will investigate the matter & will initiate further appropriate actions. The dealer has filed the annual returns for 2013-14 but there are doubts about declared LBT taxable turnover.

The search operations were conducted under the guidance of Hon’ble Municipal Commissioner, Shyam Wardhane and Hon’ble A.Dy.M.C. Pramod Bhusari, under the supervision of Milind Meshram, Assistant Commissioner(LBT). The officers/officials involved in the operation are Yadav Jambhulkar, Rajesh Meshram, Tarachand Khandate, LBT Officer ; Inspectors Sanjay Mendule, Vilas Chahande, Ramesh Paddhan, Sumer Gajbhiye, Nana Dhote, Suresh Dhupe; Jr Inspectors Prashant Kawalkar, Shailesh Bharadwaj; Mohrir Nana Kakade and Driver Prakash BOLAKHE, Raju Sonekar, Sheshrao Shinde.

Many dealers are importing goods and not making LBT payments on the pretext of news in local dailies that LBT will be scrapped. The dealers should take note that even if the LBT is scrapped it will be from the date of such notification by the Government. Therefore, the dealers are requested to pay LBT as per the rules on the goods imported till date to avoid action by the department.
