LBT search at Genetech engg solutions and Kushi Creations

: Local Body Tax department conducted Search & Seizure Operation at the establishment named M/s Genetech Engineering solutions,184, Raigad Apartment Chattrapati Square, Ring Road, Nagpur. The establishment is owned by Umakant Rothe, a dealer trading in BLUE STAR branded AC, water cooler, cold room, spare parts & Electronics goods and is registered under LBT. The dealer had purchased goods worth Rs. 14.22 crore since inception of LBT, but he has declared the LBT taxable turnover Rs.26,74,990/- only in LBT annual return for the financial year 2013-14, as there was a doubt about declared LBT taxable turnover & payment of LBT, hence during the operation the department has seized the relevant documents such as 45 files of purchase & sales invoices. The Department will investigate the matter & will initiate further appropriate actions.

Another search operation was conducted on the establishment named M/S Kushi Creations, Vinkar Bhavan, Gandhibagh, Nagpur owned by Kamal Sunderlal Wadhawa. The dealer is trading in Sarees and is registered under LBT . The dealer has imported goods approximately worth Rs.1 crore since the commencement of Business but has not paid single penny LBT & also not filed the LBT annual return for the financial year 2013-14. During the operation it has been also noticed that in the same premises, the goods saree of approximately worth Rs.4 crore had been imported in the name of M/S Gurukripa textile owned by Mohan Wadhawa, since the inception of LBT, but has not paid single penny against LBT & also not filed the annual return for the year 2013-14. The dealer has not declared two additional places of business. The Department has seized the relevant documents such as 6 files of purchase invoices. As per LBT rule now the dealer will have to pay the penal amount @ two times of LBT amount.

The search operations were conducted under the guidance of Municipal Commissioner, Shyam Wardhane and A.Dy.M.C. Pramod Bhusari, under the supervision of Milind Meshram, Assistant Commissioner(LBT). The officers/officials who involved in the operation were Rajesh Meshram, LBT Officer ; Inspectors Suresh Dhupe, Dilip Matey, Ulhas Motaghare; Jr Inspectors Shailesh Bharadwaj, Shri Vijay Chetanani, Mehrulia; Mohrir Shri Firoz Quazi and Driver Raju Sonekar, Sheshrao Shinde; It is being coming to the fore that many dealers are importing goods and not making LBT payments on the pretext of news in local dailies that LBT will be scrapped. The dealers should take note that even if the LBT is scrapped it will be from the date of such notification by the Government. Therefore, the dealers are requested to pay LBT as per the rules on the goods imported till date to avoid action by the department.
