‘Illegal’ multi-storied building in ‘Malabar Colony’ faces bulldozer

A multi-storied building, being constructed ‘illegally,’ in the disputed ‘Malabar Colony’ faces the bulldozer. The building has been constructed without the nod from Nagpur Improvement Trust, Nagpur Municipal Corporation and District Collector’s Office, claimed the office-bearers of Malabar Colony Residents Association.

The matter came to light when the Association’s representatives Vijay Golchha, Mohan Kapre, T Singh, Secretary Prakash Vanjari and President Mehandi Ratna on Thursday called on the District Collector and apprised him about the ‘illegal’ construction. The District Collector, on his part, directed the Naib Tehsildar, Tehsildar and Patwari to carry out inspection of the said building. Subsequently, the officials made a spot inspection and found that the land belongs to MECL and District Collector Gaothan (Khasra No. 1). On the same Khasra No. 1 land, the ‘illegal’ construction is underway. It is further revealed that the builder had originally procured sanction for Khasra No. 2/1 having 2200 sq mtr land. On the same land, 8 plots were carved out and sold in 1980. The said ‘illegally’ constructed multi-storied building houses a total of 19 flats, claimed the Association.

With the finding, the team of district administration performed ‘panchnama’ and slapped notices on chief of the building Gulabsingh Baghel. The duo has been asked to produce ownership and other relevant documents within eight days.

According to sources, the construction of the posh, multi-storied building was initiated in Malabar Colony last month. Till now, five floors have been completed. The entire building will have 19 flats to be priced between Rs 75 lakh and Rs 1 crore each. The builder has allegedly encroached upon the road in the Colony for construction of the said building.

The Association further alleged that a  ‘grabbed’ Khasra No. 2/1 2200 sq mtr land from MECL and District Collector Gaothan (Khasra No. 1) by ‘dubious means’. The land was shown as Plot Nos. 39 and 39A. The builder is constructing garbage dump at Plot No. 39 and the said multi-storied building at Plot No. 39A.

It may be recalled that the development of Malabar Colony area was initiated by NIT under Gunthewari Scheme (1900 Layouts). However, with nasty designs in his mind, sidelined the NIT norms for construction of the said building claiming that the land did not belong to NIT at all. The builder fiddled with the documents and, with babus of Town Planning Department hand in glove, started construction of the said building. However, when a team of NIT had inspected the construction site 3-4 times in the past, it has come to the fore that NIT had never given nod for construction of the building.

On Thursday (April 20), on the directives of District Collector, a team of Naib Tehsildar, Tehsildar and Patwari carried out the spot inspection. The team asked the contractor named Kulkarni to produce ‘title deed’ and other documents. Taken aback by the demand, Kulkarni called . A few minutes later, and his partner Baghel appeared before the team. However, when the team asked to sign the panchnama, he in turn told Baghel to sign the panchnama and he himself ‘vanished’ from the spot. In accordance with the contents of the panchnama, the builder has been asked to produce land ownership documents, sanctioned map etc.

Water, power connections to the ‘illegal’ building:

Surprisingly, the Water Works Department of NMC and MSEDCL have provided water and power connections for construction of the said building which has no nod from NMC and NIT. Both the connections are in the name of (Khasra No. 1).
