Nagpur: Filing a case without any solid evidence proved dearer to a lawyer when Nagpur Bench of Bombay High Court, on Monday, imposed a fine of Rs 1,000 on her. Lawyer Megha Bhale had filed a petition under the RTI Act, 2005 without proper inquiry and data.
A division bench consisting of justice Bhushan Dharmadhikari and justice Vinay Deshpande rejected her plea alleging that finance minister Sudhir Mungantiwar had not mentioned a farm house in affidavit for the 2014 assembly elections. The farmhouse was constructed on Mungantiwar’s father’s land in Chandrapur at a cost of Rs 20 crores. The plea was filed under article 226 of the constitution.
Additional government pleader Sagar Ashirgade told TOI the petition was filed after the Anti-Corruption Bureau did not conduct investigations into the matter. “The court said that Mungantiwar’s father should have been named as one of the respondents to the petition. The case could not stand without it,” he said.
The court asked Bhale to pay Rs 1,000 to the High Court Legal Services Sub-Committee within two weeks.
