HC directs varsity to file detailed affidavit on ‘Jumping’ in a day

Hearing the petition of engineering students debarred from taking up summer examinations, the High Court on Tuesday directed Rastrasant Tukdoji Maharaj Nagpur university(RTMNU) administration to file an affidavit mentioning the detailed information on its September 13, 2013 notification in this regard. The next hearing is on Wednesday.

Arguing on behalf of the engineering students Advocate Bhanudas Kulkarni mentioned that the ordinance 27/2008 read with 6/2010 does not have relevance with the notification of September 13, 2013. The admissions of these students were done under the said notification. But in this case university administration did not break up the ordinance of 27/2008 read with 6/2010 and instead issued a special notification, which was expected to be presented before the Management Council. RTMNU forwarded it to the Chancellors office. Chancellor’s office referred it back to the Management Council.

Adv Kulkarni also argued that the said notification was passed by Academic Council and by special powers of the Vice Chancellorunder sec 14(7) of the Maharashtra Universities Act, 1994 but without the consent of the Management Council.

Kulkarni argued that it is important to clear the exact scenario on the status of these students. Considering the plea of the students council the Court asked the university to come clear on this issue.
