Can the bride refuse triple talaq in nikaahnama, SC asks AIMPLB

New Delhi: A five-judge bench of the Supreme Court is hearing the contentious triple talaq case. Yesterday, equating the issue with the belief that Lord Rama was born in Ayodhya, the All India Muslim Personal Law Board had told the apex court that these were matters of faith and “cannot be tested on grounds of constitutional morality’.

Today Chief Justice of India JS Khehar asks Kapil Sibal(lawyer for the All India Muslim Personal Law Board) if it is possible to give a bride the right to refuse to accept instant triple talaq? The SC also wanted to know from the AIMPLB whether the board’s advisory will be followed by the Qazi at the ground level.

The SC asks the AIMPLB if it can aks Qazis to have a model ‘Nikah Nama’? “Why can’t there be a modern and model ‘Nikah Nama’ to provide for talaq? Can a woman be given an option to say no to triple talaq at the time of nikahnama,” the SC asks the AIMPLB.

One of AIMPLB’s lawyers, Yousuf Muchala, told the Supreme Court that the board’s advisory is not mandatory for all Qazis to follow. The AIMPLB lawyer also said that the board accepts the suggestions in all humility and will look into it. The AIMPLB also showed SC a resolution passed on 14 Apr 2017 which says triple talaq is a sin and community should boycott the person doing it.
