Gujarat’s 10% quota for economically backward rejected by HC

gujarat-high-courtAHMEDABAD: The High Court in Gujarat today rejected the state government’s ordinance providing members of the economically weaker sections from unreserved category 10 per cent reservation in government jobs and educational institutions.

The court was hearing petitions challenging the state government’s May 1 ordinance. Petitioners Dayaram Verma, Ravjibhai Manani, Dulari Basarge and Gujarat Parents’ Association had separately challenged the ordinance that allowed 10% reservation to candidates belonging to the unreserved category with family income cap of Rs. 6 lakh per year.

The petitioners had submitted that the reservation violates the Supreme Court’s order providing 50 per cent ceiling for reservation. They said that additional 10 per cent reservation further reduced the number of seats in educational institutions for candidates from unreserved category with annual family income of more than Rs. 6 lakh.

But the government contended that the reservation was a further classification in the general and unreserved category and does not violate either the Supreme Court order or the constitution.
