LBT department conducts search and seizure operation at various establishment in city

Nagpur:  On Monday, Local Body Tax department conducted Search & Seizure Operation at M/s Ten Dollar Shop, Near Baidnath Shop, Choti Masjid, Sitabuldi main road, Nagpur; owned by Mohd. Jafar Mohd Ayub. LBT Department noticed that the dealer has imported readymade cloths and also made URD purchases. The search team found invoice file containing about 50 doucments pertaining to the purchases made by the dealer. Local Body Tax is incepted since 1.4.2013; but the dealer carried out the business without obtaining the LBT registration and thus is evading taxes since last about 18 months. The dealer has not maintained any record or accounts in regards to his business. As per the inventory of goods recorded by the search team, goods approximately worth Rs. 3.70 lacs are found to be stocked in the shop.

Another Search and Seizure action was conducted on the establishment, M/s Burhani Hardware & Paints, Shop No.1, Tirupati Apartment, Wardhman Nagar, Central Avenue, Nagpur; owned by Mohd. Fakruddin Sunelwala. The dealers turnover for the financial year 2013-14 is about Rs. 24,52,000. The dealer is registered under LBT but has made payment of LBT to the tune of Rs. 4,365only till this date. The dealer has not maintained the purchase accounts and has also not filed the annual returns as required under the Rules. The purchases made by the dealer will be verified by the department.

As per the search and seizure action conducted at M/s Yashodeep Hardware Paints, Pipla Fata, Hudkeshwar Road, Nagpur; the dealer trading in asian paints has turnover of Rs. 5,82,033and 3,71,308in the financial years 2013-2014 and 2014-2015, respectively. The dealer has not made any LBT payments.

Search & seizure was also conducted on M/s Mahadeo Light House, Golibar chowk owned by Vinod Kumar Shrichand Tharwani. The dealer trading in electrical goods has paid LBT amounting to Rs. 30.000till date but has not filed annual return, as required under the rules.

Another search & seizure was conducted on M/s Shivam Sales, Near Alankar Cinema, Dharampeth, Nagpur. The dealer is trading in building construction material and his turnover for the financial years 2013-2014 and 2014-2015 amounts to Rs. 23,76.495and Rs. 2,60,060respectively. The dealer has not filed his annual returns and the imports made by the dealer will be verified by the department.

As per LBT Rule 9(1), a dealer liable for registration could not carry the business within the city without obtaining LBT Registration. LBT department has observed that many dealers are purchasing and importing various goods without being registered under LBT. Department with the help of intelligence and informations forwarded by dealers suffering from such practices, has located and short listed many such dealers and shall initiate Search and Seizure action as per section 152J of Maharashtra Municipal Corporations Act, 1949; against all such dealers in future.

The above actions were initiated by LBT Officers, Yadav Jambhulkar, Venkat Jichkar, Rajesh Meshram; Asstt. LBT Officers, Narayan Wankhede, Dattaraj Wankhede, D.N.Dhote, Sanjay Mendule, Ramesh Padghan, Sumer Gajbhiye, Ulhas Motghare, Dilip Mate, Vilas Chahande; Jr. Inspectors Jeetendra Tomar, Kishore Charde, Chandrashekhar Mohite, Kailash Uikey, Prashant Kawalkar, Vijay Chetnani, and Assistants Shashikant Samundre, Vijay Lute, Ramchandra Raut, Aamir Hussain, Dilip Choudhari, Mehrulia, Nagbhide, Firoz Kazi, Khapekar, Shailesh Bharadwaj. The operations were conducted under the able supervision of Milind Meshram, Assistant Commissioner (LBT) and valuable guidance of Hon’ble Municipal Commissioner and Hon’ble Addl.Dy.Mpl.Commissioner(1).
