Nagpur News : Justice Bhushan Dharmadhikari and Justice P.R.Bora, at the High Court here, have directed the RTM Nagpur University to take appropriate decision in 3 weeks, against the professional colleges affiliated to it, which are functioning with no teacher or are deficient and not having adequate number of qualified teachers. These colleges conduct courses in Engineering, Pharmacy, Education, Architecture, Computer Application, Law etc.
The court has issued direction after hearing the petitioner,Sunil Mishra, who appeared in person in his PIL regarding professional colleges functioning without hindrance , though they are deficient in teaching staff and some of them do not have even a single teacher.
Senior counsel A M Gordey appearing for the university with Advocate Sudhir Puranik prayed for 6 weeks time, which the court did not grant.
It was urged by the petitioner Mishra, that petitions of 250 banned colleges managements have been rendered infructuous and those can be disposed of as such,but his petition in respect of professional colleges being run without qualified staff illegally and irregularly requires urgent attention, because professional colleges bosses hold whip hand in the University affairs and it does not touch them ,taking cover of the cases of the banned colleges.It has been pointed out that data in this regard is available, but the University has till date shown no interest in taking any action against these colleges.
The court did not accept contention of the University that in respect of the professional colleges power to take action vests in the AICTE and other apex-bodies.This contention by the university was also not accepted that these apex-bodies should have been joined as respondents to this petition , also did not find favour with the court.
The RTMNU conceded that its order of May 3, 2013 was also applicable to the professional colleges , but none of deficient amongst them, find place in the list of teaching staff wise deficient colleges.The Court has been of the view that several judgments of the apex-Court affirm the authority of the University to take action.
The data about the deficient colleges was available with the University, hence it was given direction to act. Advocate B.G.Kulkarni appeared for the petitioner managements of some of the banned colleges.
