Allahabad HC grants Raje Bhonsale four-week time to file reply in property deal fraud case

Raje Raghuji Raje Bhonsale, who has been booked by Varanasi police on the charges of fraud, criminal conspiracy and breach of trust pertaining to a property deal in Varanasi, has been granted four weeks time by Allahabad High Court to file his rejoinder to the objection filed by the plaintiff Sixth Sense Astro Gurukul Chairman Arun Kumar Gupta against the stay on Raje’s arrest. Raje Raghuji Raje Bhonsale had sought time from the High Court to file his reply during the hearing in the case on Saturday.

Meanwhile, Varanasi police on Saturday served a notice to Raje Raghuji Raje Bhonsale again. The notice has asked him to present himself at Cantt Police Station on September 3.

It may be recalled, Nagpur’s Raje Raghuji Raje Bhonsale, son of late Raje Ajit Singh, resident of Senior Bhonsale Palace, Mahal Nagpur and 11 others were booked by Varanasi police on the charges of fraud, criminal conspiracy and breach of trust pertaining to a property deal in Varanasi. The Bhonsale scion and others were been booked by Cantt Police Station of the UP city under Sections 406, 420, 467, 468, 471, 120B, 506 of the IPC in the FIR No. 101/2014. The Varanasi police had summoned Raje Raghuji Raje Bhonsale and others to be present on September 3. However, the accused had procured a stay from Allahabad High Court to avoid the arrest. The next hearing in the case was slated for August 29. The fraud has prima facie been endorsed by a Revenue Inquiry ordered by District Magistrate.

According to detailed reports, Raje Raghuji Raje Bhonsale owns an ancestral property named “Bhonsale Ghat” on the shores of River Ganga in Varanasi. Raje had negoatiated a deal to sell the property through his Divan Pradeep Deshmukh and lawyer Vishwanath Pandey to a Noida resident and Chairman of Sixth Sense Astro Gurukul Arun Kumar Gupta. The deal was fixed at Rs 2.60 crore and an agreement in this regard was done on May 15, 2013. Arun Kumar Gupta, according to the agreement, made a payment of Rs 83 lakh, too. Moreover, with the mutual consent between Raje Raghuji Raje Bhonsale and Arun Kumar Gupta, the agreement was extended till July on May 1.

In the meanwhile, according to reports, Raje Raghuji Raje Bhonsale hatched a conspiracy and breached the agreement by selling the Bhonsale Ghat property on June 25 to Avantika Agro Services Private Limited, Varanasi for Rs 5.10 crore. The owners of this company namely Aditya Gupta and his wife Avantika run a hotel which is located adjacent to Bhonsale Ghat.

According to the FIR, the breach of agreement, out of greed on the part of Raje Raghuji Raje Bhonsale, amounted to fraud with Arun Kumar Gupta. Moreover, Raje’s lawyer had sent a notice to Arun Kumar Gupta on June 26 informing him that Raje is cancelling the agreement unilaterally when the Registry in favour of Avantika Agro Services Private Limited was done on June 25 itself by taking Rs 30 lakh out of Rs 5.10 crore deal.

According to reports and the FIR, the accused committed another crime of grave nature to hide notice fraud by changing the date in Registry Document. The Revenue Inquiry ordered by District Magistrate has found the overwriting in Registry Document and the date 25 was erased and changed to 26 to justify the notice sent to Arun Kumar Gupta. The Revenue Inquiry report was submitted on August 8 which exposed the fraud thoroughly.
